Terms of Service
These Terms of Service (the "Terms") form a binding agreement between Squadpitch LLC ("Squadpitch", "we", "us") and you, the person or entity using the Squadpitch service. By creating an account or using the service you agree to these Terms. If you do not agree, do not use Squadpitch.
1. The service
Squadpitch is AI-assisted software that helps real estate agents, small businesses, and teams generate, schedule, publish, and analyze social media content. Typical workflow: you provide source material (a listing URL, website, brand notes, images), Squadpitch extracts and structures it, our AI generates captions, hooks, hashtags, and media, you review and approve the drafts, and Squadpitch publishes them to the social channels you have connected on the schedule you set.
Squadpitch is operated from the United States. The product is intended for business use and is not designed for consumers acting outside a trade or profession.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use Squadpitch. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Authentication is provided by Auth0. You are responsible for keeping your login credentials confidential and for the activity that occurs under your account. Notify us at support@squadpitch.com if you suspect unauthorized access.
3. Workspaces and team members
Squadpitch organizes work into workspaces. The user who creates a workspace is the workspace owner and is responsible for the people they invite to it, the content stored in it, the social accounts connected to it, and the actions those people take inside it. Removing a member does not delete the content they generated; the workspace owner controls retention.
4. Your content; license to operate the service
You retain ownership of the content you upload, paste, or generate through Squadpitch ("Your Content"), including drafts, uploaded images, listing data, brand assets, and generated output you save or publish.
You grant Squadpitch a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, copy, modify (only as needed for resizing, encoding, and similar processing), and forward Your Content to the third-party services you choose to use (AI providers, social platforms, hosting / media providers) solely to provide the service to you. You also grant us the right to retain aggregated, de-identified usage data for product analytics and security.
You represent that you have the rights, licenses, and consents necessary for everything you upload or paste, including listing photos, videos, brand assets, and any third-party trademarks or copyrighted material.
5. AI-generated content — review before publishing
Captions, hooks, hashtags, and images you produce through Squadpitch are generated by third-party AI models. AI output can be inaccurate, biased, infringing, non-compliant with platform or industry rules, or simply off-brand. You are solely responsible for reviewing and approving every draft before it publishes. Squadpitch makes no representation that AI output is accurate, fit for any particular purpose, original, non-infringing, or compliant with any law, advertising standard, fair-housing requirement, MLS rule, or platform policy.
Scheduled / autopilot features default to draft-only mode so a human approves before posting. If you enable an auto-publish mode, you accept that decision and the resulting risk.
6. Real estate, fair housing, and platform compliance
Real estate marketing is regulated. If you publish listings or property content through Squadpitch, you are responsible for following the federal Fair Housing Act, state and local fair-housing rules, your MLS rules, brokerage requirements, advertising laws, disclosure requirements, and the rules of every social platform you publish to. Squadpitch is a tool — not a compliance check.
7. Connected social accounts and third-party platforms
Squadpitch lets you connect third-party social platforms (such as Meta's Facebook and Instagram, TikTok, X, LinkedIn, YouTube, Google Business Profile) and cloud storage services (such as Google Drive, Dropbox) via OAuth. When you connect an account, Squadpitch stores an encrypted access token (and refresh token, where issued) and basic profile metadata so we can publish on your behalf and read engagement data for the analytics you see in Squadpitch.
Each connected platform is operated by its own provider with its own terms and policies. We do not control whether a platform will accept, publish, continue to display, or moderate any post. We do not guarantee that a connected platform's API will continue to support every feature we use today; if a platform changes or removes an API, the corresponding Squadpitch feature may change or stop working.
You may disconnect any connected account at any time from Settings → Channels. Disconnecting deletes the stored token. Some historical posts may remain on the connected platform after you disconnect — manage those through the platform itself.
8. Subscriptions, billing, trials, and cancellations
Squadpitch offers a free tier and paid plans (currently Solo, Pro, Team, and Agency). Paid plans are billed monthly through Stripe. You authorize Stripe to charge the payment method on file at the beginning of each billing cycle, and you authorize us to update plan status based on what Stripe reports.
Plan limits — including monthly post / image / video / generation quotas, workspace counts, and team-member counts — are described on the public pricing page. Limits reset at the start of each calendar month. Overage above your plan's limits is blocked rather than billed unless we expressly tell you otherwise.
You may upgrade, downgrade, or cancel at any time from Settings → Billing. Stripe handles proration. Cancellations take effect at the end of the current paid period. Refunds are evaluated case-by- case at our discretion; reach out to support@squadpitch.com if something didn't work as intended.
Prices are exclusive of any applicable taxes, which are your responsibility.
9. Acceptable use
You agree not to:
- Publish content you do not have the rights to publish.
- Spam, mislead, harass, or impersonate other people or brands.
- Use Squadpitch to generate or publish content that violates the terms of any connected social platform, any law (including advertising, fair-housing, securities, and consumer protection laws), or any rights of a third party.
- Attempt to bypass rate limits, scrape Squadpitch's APIs, reverse engineer the service, or share access credentials.
- Probe, scan, or test the vulnerability of our systems without our prior written permission.
- Use the service to develop a competing product or to train a machine-learning model.
We may suspend or terminate accounts that violate this section, with or without notice depending on the severity.
10. Suspension and termination
We may suspend or terminate access to the service if you breach these Terms, if your payment method fails, if a connected platform demands it, or if continued operation creates legal or security risk for us or other users. You may terminate at any time by canceling and deleting your account; see the Privacy Policy for how to request data deletion.
Sections that by their nature should survive termination (intellectual property ownership, indemnification, limitation of liability, governing law, dispute resolution) survive.
11. Squadpitch intellectual property
Squadpitch, the Squadpitch logo, the design of the application, and all software making up the service are owned by Squadpitch LLC. Nothing in these Terms transfers any ownership of our intellectual property to you. You may use the service only as permitted by these Terms.
12. Service availability and disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SQUADPITCH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT AI-GENERATED OUTPUT WILL BE ACCURATE, ORIGINAL, OR COMPLIANT; OR THAT ANY CONNECTED PLATFORM WILL ACCEPT, PUBLISH, OR CONTINUE TO HOST CONTENT PUBLISHED THROUGH US.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SQUADPITCH LLC'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SQUADPITCH IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, REPUTATIONAL HARM, OR THIRD-PARTY PLATFORM CONSEQUENCES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
14. Indemnification
You will defend, indemnify, and hold harmless Squadpitch LLC and its officers, employees, and agents from and against any third-party claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of or related to (i) Your Content, including content you publish through Squadpitch; (ii) your use of the service in violation of these Terms or applicable law; or (iii) your violation of the terms of any connected platform.
15. Governing law and dispute resolution
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-laws principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in Hamilton County, Ohio for any dispute that cannot be resolved informally, except that either party may seek injunctive relief in any court of competent jurisdiction.
16. Changes to these Terms
We may update these Terms as the product evolves. Material changes will be communicated by email to the address on your account or through an in-product notice. Continued use after the effective date of the updated Terms constitutes acceptance.
